Terms of Service

Short version: Engagements run on a signed agreement. These terms cover everything that agreement doesn't, plus this website and anything you buy from us online.

These terms are between you and PKGSYSTEMS, LLC ("PKG Systems", "we", "us"), a New York limited liability company. They apply to www.pkgsystems.com, to services we provide, and to purchases made through payment pages we operate. Written in plain language on purpose. Effective 2 September 2026.

Using this website

The content on this site is informational. It describes what we do and how we work; it is not a proposal, a quote, or professional advice for your situation. Everything here is ours or used with permission. You may read it, link to it, and quote it with attribution. You may not scrape it, republish it as your own, or use it to train machine learning models.

Engagements

Our work is delivered under a written agreement: a discovery agreement, a build agreement, a run agreement, or a master agreement with statements of work. That agreement governs scope, deliverables, schedule, price, ownership, confidentiality, and everything else specific to the engagement. Where these terms and a signed agreement differ, the signed agreement wins.

Our engagement model is described on the approach page: a fixed-price discovery, a fixed-price build, and a monthly run-rate. Nothing on that page is a commitment until it is in a signed agreement with your name on it.

Payment

We invoice through Stripe. Each invoice says what it covers and when it is due. Unless the invoice or your agreement says otherwise, invoices are due 30 days from the invoice date.

You can pay an invoice by card, by ACH Direct Debit, or by bank transfer, on the invoice's payment page. Card details and bank details are entered on pages hosted by Stripe; we never see or store them. Our privacy page describes what we do receive.

Prices are in US dollars and exclude any sales or use tax that applies to you. If a payment fails, we will tell you and try again; if an invoice stays unpaid past its due date, we may pause work under the agreement it covers until it is settled.

If you think an invoice is wrong, email help@pkgsystems.com before disputing the charge with your bank. We fix mistakes quickly; a chargeback takes weeks and helps nobody.

Refunds and cancellation

  • Discovery and build. These are fixed-price engagements for work performed. Cancellation and refund terms are set in the engagement agreement. Absent other terms, work completed and accepted before cancellation is paid for and not refundable; work not yet started is not billed.
  • Run. Monthly run-rate services can be canceled by either side with 30 days' written notice. You are billed through the end of the notice period. We do not refund a month that has started.
  • Online purchases. Where you buy something from us directly on a payment page, the refund terms shown on that page apply. If none are shown, contact us within 14 days of purchase and we will make it right.

Your data

Data you give us for an engagement stays yours. Our standard model is single-tenant: your environment runs only your workloads, we operate it exclusively for you, and we never aggregate your data with anyone else's or use it to train models. Warranties and liability

We do good work and we stand behind it in the agreement that covers it. This website and anything on it is provided as is, without warranty of any kind. To the extent the law allows, our total liability to you under these terms, for any claim, is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential losses, including lost profits or lost data, arising from use of this website or from an online purchase, except where a signed agreement says otherwise or the law does not permit the limitation.

Changes

We may update these terms. The effective date at the top moves when we do, and material changes will be noted on this page. Continued use of the site or the services after a change means the new terms apply. A signed agreement is not changed by an update here.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute that cannot be resolved by talking to us first will be brought in the state or federal courts located in Albany County, New York.
